Tobacco & Nicotine Product Purchase Age & Tax Increase for 2020

On October 22, 2019, the Gypsum Town Council adopted Ordinance No. 10 (Series 2019) amending title five of the Business Taxes, Licenses and Regulations of the Town of Gypsum Municipal code. This new resolution requires retailers that sell cigarettes, tobacco and nicotine products to be licensed and raises the minimum legal sales age for these products to 21. All tobacco retailers in the Town of Gypsum must be compliant with this new licensing by January 1, 2020. Enforcement of the increased age threshold will also begin at that time.

The Gypsum Town Council adopted this ordinance to align the town’s code to reflect Eagle County’s recent changes to tobacco laws. The new Eagle County laws attempt to reduce youth access to tobacco products, particularly vaping products which are utilized at high rates by Eagle County youth. By adopting a similar ordinance, the Town of Gypsum avoids having varying sales ages and regulations in each Eagle County community, which would work contrary to the public health intent of these new laws. 

In addition to the age increase, in November, Eagle County residents voted to approve an increase in taxes on cigarettes, tobacco, and nicotine products in 2020. Therefore, per Resolution No. 2019-064, Eagle County is authorized to collect this tax from unincorporated areas of the county and municipalities within the boundaries of the county that do not levy a municipal sales tax on such products (like the Town of Gypsum) beginning January 1, 2020. The tax will be $0.20 per cigarette or $4 per pack of 20 cigarettes sold, and sales tax of 40% on the sale price of other tobacco and nicotine products within the Town of Gypsum boundaries.
